內容

課程概述

保險法課程，以我國保險法的介紹為主，除法法律條文以外，契約條款、業界常規、法院判決、行政決定與學說研究，亦在對照審視之列。同時，適時以比較法之方法剖析現行法制基本結構和基本概念，藉此學生奠定未來研究保險法之學術基礎。

The purpose of this course is to give students an introduction to the statutory and administrative bases of Taiwan insurance law. To perceive the full meaning, the statutes shall be viewed against the multifaceted background of contract terms, industry practices, court decisions, administrative ruling, and scholar analysis. We also put emphasis on promoting students Analysis ability for further research in the future.

授課內容

本課程的目的，在給予學生關於臺灣保險法關於法令與行政基礎的介紹。為了充分瞭解其意義與衝突，法律條文應與已施行多年而累積的契約條款、業界常規、法院判決、行政決定與學說研究相對照，而加以審視。此外，本課程也將提供關於臺灣保險法體系的充分資訊，而有助於與德國及美國作一般性的比較，且針對一已被認為理所當然的合理制度再予評估, 而提供有價值的觀察，以期能激發進一步的比較研究。
