課程概述

在台灣,以「勞動法」(或「勞工法」)為名的法律並不存在,勞動法只是泛指與「勞動」、「勞工」有關的法令。台灣現行的主要勞動法規,除了勞動基準法以外,所謂的勞動三法(工會法、團體協約法、勞資爭議處理法)和工廠法等,均是國民政府於1930年前後所制定。國民政府遷台之後所制定的勞動法規,以1987年解嚴為分水嶺,其內涵似乎有所不同。解嚴前,工會法、團體協約法、勞資爭議處理法等「集體勞動法」領域沒有太大的變化;在「個別勞動法」領域為了保障勞工的福利和勞動條件,除制定了勞工安全衛生法以外,最重要的是以既存的工廠法為基礎而制定了勞動基準法;在「勞動市場法」領域則有勞工保險條例和職業訓練法。但是在解嚴之後,配合台灣的政治、經濟、社會環境的變化,在「勞動市場法、雇用政策法」領域制定了就業服務法、就業保險法;在「個別勞動法」領域除修訂勞動基準法之外,尚制定了職業災害勞工保護法、兩性平等工作法、大量解僱勞工保護法、勞工退休金條例;「集體勞動法」領域則是作了重大之修正,從嚴格管理工會的立場轉變為勞資自治的立場。

The main current labor laws in Taiwan, in addition to the Labor Standards Law, include the so-called Labor Three Laws (Trade Union Law, collective bargaining agreement, Labor Dispute Resolution Law) and Factory Law, all of which were legislated  by the Central government around 1930. The labor regulations legislated by the Nationalist government after its relocation in Taiwan, with the lifting of martial law in 1987 as the watershed, seem to have different connotations. Before the lifting of martial law, there were not significant changes in the field of collective labor law, such as trade union law, collective bargaining law, and labor dispute resolution law; In the field of individual labor laws, in order to ensure the welfare and working conditions of workers, in addition to legislating labor safety and health laws, the most important thing is to establish labor benchmark laws based on existing factory laws; In the field of labor market law, there are labor insurance regulations and vocational training laws. However, after the lifting of martial law, in response to changes in Taiwan's political, economic, and social environment, the Employment Service Act and Employment Insurance Law were legislated in the fields of Labor Market Law and Employment Policy Law; In addition to revising the Labor Standards Law, the Occupational Safety and Health Act, Gender Equality Work Law, The Act of the Protection of Employees During Mass Redundancy, and Labor Pension Regulations have also been legislated in the field of "Individual Labor Laws"; In the field of collective labor law, significant revisions have been made, shifting from a strict management of trade unions to a position of labor management autonomy.
