內容

課程概述

本項課程主要就經濟學與法律學之角度分析反托拉斯政策訂定與執行之背景，並以我國反托拉斯法體系與產業結構為對象，說明政府如何藉法律規範限制競爭行為(獨占、結合、聯合)，以因應全球化對我國經濟體系的衝擊。此外，本課程並將透過國內外重要的反托拉斯案例，由修課者實際分析相關經濟、法律及所內涵之產業運作層面。

This course investigates the legislation and enforcement of competition law from the viewpoints of economics and law. It will use the Taiwanese Fair Trade Law as the object to study issue of monopoly, merger and concerted actions. The purpose is to investigate how competition regime can respond the globalization shocks on Taiwanese economy. The expected results for the students are that they can understand the market mechanism from the viewpoint of industrial development by studying the theoretical models and real world cases. They can also investigate the related issues from both the sides of law and economics.

授課內容

本項課程主要係就經濟學之角度分析法律訂定與執行之背景，並將以我國競爭法體系與產業經濟學為例，說明公平交易法中規範獨占、結合及聯合相關條文之立法宗旨及適用範圍，並透過國內外重要的併購案例，由修課者實際分析相關經濟、法律及所內涵之產業運作層面。個人的教學計畫與教材，不僅要學生了解各類行為的決定誘因，也要具有研究經濟現象因果關係及其對策的能力，希望修課者能透過理論與實務的整合，配合我國產業的發展環境，積極開展可與此環境相結合的各項法律研究。
